Swiss law allows either the employer or the employee to terminate the employment contract without cause.<\/p><p>In most cases, the law does not stipulate any formal requirements for the conclusion of an employment contract (art. 320 CO). It is therefore possible to conclude an employment contract <strong>orally<\/strong>, <strong>or in writing<\/strong> or even conclusive acts.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e23e796 elementor-widget elementor-widget-heading\" data-id=\"e23e796\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Characteristics of Employment Contracts in Switzerland<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-665dcaa elementor-widget elementor-widget-text-editor\" data-id=\"665dcaa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In Switzerland, an employment contract includes <strong>4 characteristics<\/strong>:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-24a7326 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"24a7326\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">1) The worker undertakes to work, i.e. to carry out an activity<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">2) The worker carries out this activity for a period of time (fixed or indefinite).<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">3) The worker acts in the service of the employer, in a relationship of subordination.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">4) The employee receives a salary<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-63b9d47 elementor-widget elementor-widget-text-editor\" data-id=\"63b9d47\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The <strong>subordinate relationship<\/strong> is the essential distinguishing criterion of an employment contract from other contracts. In the event of a dispute over the classification of a contract, the judge will carefully analyze whether there is a relationship of subordination between the contracting parties.<\/p><p>This problem often arises when it comes to distinguishing between a contract of agency and a contract of employment. This distinction is very important in practice, as the employment contract may be subject to numerous rules designed to protect the employee (e.g. notice period to terminate the contract, <strong><a href=\"https:\/\/fidulex.ch\/en\/minimum-wage-in-geneva\/\">minimum wage<\/a><\/strong>, <strong><a href=\"https:\/\/fidulex.ch\/en\/collective-labor-agreements-in-geneva\/\">Collective Labour Agreements<\/a><\/strong>etc.).<\/p><p>What's more, the self-employed agent alone pays 100 % of his social security contributions, whereas in principle the employer and the employee bear 50 % of the payment of these charges.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7bb9d5f elementor-widget elementor-widget-heading\" data-id=\"7bb9d5f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Termination of a Swiss Employment Contract<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3782d3d elementor-widget elementor-widget-text-editor\" data-id=\"3782d3d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4d34abcb elementor-widget elementor-widget-text-editor\" data-id=\"4d34abcb\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\"><p>There are two types of employment contracts in Switzerland: permanent and temporary. <strong>fixed term<\/strong> and <strong>indeterminate<\/strong>.<\/p><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-852b8dc elementor-widget elementor-widget-heading\" data-id=\"852b8dc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Termination of an open-ended contract<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5c58ddc elementor-widget elementor-widget-text-editor\" data-id=\"5c58ddc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>When concluded for an indefinite period, the contract may be terminated by either party within the legal or contractual time limits, without any particular reason (art. 335 of the Swiss Code of Obligations). The notice period will depend on the employee's length of service with the company.<\/p><p>The <strong>termination of an employment contract<\/strong> in Switzerland must comply with the following points:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c751dc4 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"c751dc4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"icon icon-right-arrow1\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">A notice period (depending on seniority)<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"icon icon-right-arrow1\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">The reason for termination must not be unreasonable<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"icon icon-right-arrow1\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Notice must not be given at an inopportune time (e.g. sick leave, military service, etc.).<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bdfe269 elementor-widget elementor-widget-heading\" data-id=\"bdfe269\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Termination of a Fixed-Term Contract<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-824b0e9 elementor-widget elementor-widget-text-editor\" data-id=\"824b0e9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A fixed-term contract can only be terminated for \"just cause\". According to the Swiss Code of Obligations (CO), just cause includes all circumstances which, in accordance with the rules of good faith, do not allow the person giving notice to be required to perform his or her obligations under the contract. <strong>continuation<\/strong> employment relationships.<\/p><p>The parties must therefore reach the end of the term of the contract, in order to separate or terminate it in advance by mutual agreement (art. 334 CO).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-80e5581 elementor-widget elementor-widget-heading\" data-id=\"80e5581\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Termination of an Employment Contract<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c6b9bd8 elementor-widget elementor-widget-heading\" data-id=\"c6b9bd8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Indefinite Duration<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e29631d elementor-widget elementor-widget-text-editor\" data-id=\"e29631d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In principle, the employment contract may be terminated subject to a notice period of <strong>seven days<\/strong> during the <strong>trial period<\/strong> (art. 335b CO). Unless otherwise stipulated, the trial period corresponds to the first month of employment, and may in no case exceed three months (art. 335b CO).<\/p><p>Secondly, the employment contract can be terminated subject to a notice period of<strong>one month<\/strong> during the <strong>first year<\/strong> service <strong>two months<\/strong> between the <strong>second<\/strong> and <strong>ninth<\/strong> year of service and <strong>three months<\/strong> (art. 335c CO). <\/p><p>A notice period of less than one month is only permitted during the first year of service (art. 335c para. 2 CO).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3324c69 elementor-widget elementor-widget-heading\" data-id=\"3324c69\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Fixed Term<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-13d7fd1 elementor-widget elementor-widget-text-editor\" data-id=\"13d7fd1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Unless renewed, the fixed-term employment contract may not be terminated before the end date (except for just cause or by mutual agreement between employer and employee).<\/p><p>In addition, if the parties continue their working relationship <strong>after<\/strong> the period agreed in the fixed-term contract, the law presumes that the contract will henceforth be open-ended.<\/p><p>Also, if the contract is <strong>renewed several times<\/strong> for a fixed term (e.g. two or three times), judges may consider that the contract has become an open-ended contract as well.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0c1994d elementor-widget elementor-widget-heading\" data-id=\"0c1994d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Minimum Wage<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b01b8c6 elementor-widget elementor-widget-text-editor\" data-id=\"b01b8c6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Swiss law does not provide for a minimum wage at federal level.<\/p><p>In January 2025, the canton of Geneva introduced a minimum gross hourly wage of <strong>CHF 24.48<\/strong>\u00a0of the hour. Look at <a href=\"https:\/\/fidulex.ch\/en\/collective-labor-agreements-in-geneva\/\">collective bargaining agreements<\/a> concluded in specific sectors (e.g. construction, catering or cleaning) provide for minimum wages and specific working conditions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a232c57 elementor-widget elementor-widget-heading\" data-id=\"a232c57\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Vacations<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4cd96a0 elementor-widget elementor-widget-text-editor\" data-id=\"4cd96a0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Swiss law provides for a <strong>minimum 4 weeks<\/strong> and 5 weeks for employees under the age of 20.<\/p><p>When employees are paid by the hour, their vacation entitlement can be replaced by an increase in their remuneration.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f39fd4b elementor-widget elementor-widget-heading\" data-id=\"f39fd4b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Work Periods<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9cd0e0c elementor-widget elementor-widget-text-editor\" data-id=\"9cd0e0c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In principle, the <strong>maximum weekly duration<\/strong> is <strong>45 hours<\/strong> for workers in industrial companies, office, technical and sales staff in large retail companies, and of <strong>50 hours<\/strong> for all other workers (article 9 LTr, article 2 OLT 1).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-da31039 elementor-widget elementor-widget-heading\" data-id=\"da31039\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Overtime<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cfaa5b3 elementor-widget elementor-widget-text-editor\" data-id=\"cfaa5b3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Overtime is defined as working more than the hours stipulated in your contract. However, it must not exceed the maximum working hours mentioned above.<\/p><p>Overtime can be worked at the request of either the employer or the employee.
