The main purpose of a collective bargaining agreement (CLA) is to regulate the <strong>working conditions<\/strong> and governs the relationship between the parties. The provisions contained in a CLA become part of the individual employment contract when the CLA takes effect.<\/p><p>A CLA automatically applies to workers who are members. In most cases, an employer does not have the choice of participating in a CLA in Geneva, but is subject to it by default. Its purpose is to regulate working conditions and relations between the parties. They apply solely to the employees of these companies. The <a href=\"https:\/\/www.ge.ch\/document\/15164\/telecharger\" target=\"_blank\" rel=\"noopener\"><strong>list of companies with a company-wide CLA<\/strong><\/a> is available on the State of Geneva website.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-898bd3c elementor-widget elementor-widget-heading\" data-id=\"898bd3c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The Sector CLA<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0b53c9a elementor-widget elementor-widget-text-editor\" data-id=\"0b53c9a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Unlike the company CLA, the sector CLA is an agreement concluded by a group of companies. <strong>company group<\/strong> a specific sector and <strong>unions<\/strong> agreement. Like the company CLA, its purpose is to regulate working conditions and relations between the parties.<\/p><p>For example, the collective labour agreement for the cleaning industry in French-speaking Switzerland contains the following provisions <strong>rules<\/strong> to the individual employment contract, vacation periods, minimum wages according to occupational category, working hours and hours of work, vacations, insurance, etc.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b5be642 elementor-widget elementor-widget-heading\" data-id=\"b5be642\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The extended sectoral CLA<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9640a7f elementor-widget elementor-widget-text-editor\" data-id=\"9640a7f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>An extended sector CLA is, like the sector CLA, an agreement governing working conditions and the relationship between the parties (employer and employee). When a sector CLA is extended, this means that it is binding on all companies in the affected sector, even if they have not signed the agreement.<\/p><p>This type of CLA exists when there is reason to believe that employees in a certain sector are particularly vulnerable and should be protected. <strong>protected<\/strong> extensively. This is once again the case for cleaning, but also for structural trades.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4847761 elementor-widget elementor-widget-heading\" data-id=\"4847761\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What should a CLA contain?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b5cb572 elementor-widget elementor-widget-text-editor\" data-id=\"b5cb572\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Generally speaking, a CLA must include certain elements that are similar from one CLA to another. The most common elements are listed below.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a30310f elementor-widget elementor-widget-heading\" data-id=\"a30310f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Minimum wage<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cadf69e elementor-widget elementor-widget-text-editor\" data-id=\"cadf69e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In most cases, a CLA will contain a \"Wages\" section, detailing the wages to be paid. <strong><a href=\"https:\/\/fidulex.ch\/en\/minimum-wage-in-geneva\/\">minimum wages<\/a> <\/strong>often based on the worker's training (or experience). However, some CLAs require the employment contract to be in writing and to include certain mandatory elements. The CLAs requiring this usually provide a standard employment contract.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f2d2452 elementor-widget elementor-widget-heading\" data-id=\"f2d2452\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Other provisions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4ad5e1e elementor-widget elementor-widget-text-editor\" data-id=\"4ad5e1e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Although they have certain points in common, all CLAs are different, in order to best adapt to the specificities of the sector. For example, some CLAs might include provisions on break times, required work clothing, labor peace, treatment of discrimination, etc.<\/p><p>As a general rule, the content of a CLA takes precedence over the laws applicable by default. For example, the minimum wage in a CLA is not the cantonal minimum wage, but the one specified in the CLA. Furthermore, contribution deadlines take precedence over the<strong><a href=\"https:\/\/fidulex.ch\/en\/echelle-bernoise-contribution-deadlines-and-employee-protection\/\">Bernese scale<\/a><\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-162e41b elementor-widget elementor-widget-heading\" data-id=\"162e41b\"
